Mediation Policy
This policy provides general information about HOA mediation offered by Daftari Law LLC. Every accepted mediation is governed by a separate written mediation agreement and any applicable court rules or orders.
Role of the mediator
When Shivam Daftari serves as mediator, he acts as a neutral third party. He does not represent either participant, does not become either participant's attorney, and does not provide either participant with individual legal advice.
No attorney-client privilege
Communications between a participant and the mediator do not create an attorney-client relationship or attorney-client evidentiary privilege. Mediation confidentiality, privileges, and exceptions are governed by the mediation agreement and applicable law.
Independent legal advice
Each participant may consult independent counsel before, during, or after mediation. Unrepresented participants are responsible for deciding whether to obtain legal advice regarding their rights, obligations, proposed terms, and any settlement agreement.
Neutrality and conflicts
The firm conducts a neutral-conflicts review before accepting a mediation. If a participant is a current or former client, the firm will evaluate whether service as mediator is permitted and obtain any informed written consent required by the Georgia Rules of Professional Conduct. The mediator will not later represent either participant in the mediated dispute.
No guaranteed resolution
The mediator facilitates discussion and may assist the participants in evaluating options, but cannot require settlement or guarantee a particular outcome. Any resolution belongs to the participants and should be reduced to an appropriate written agreement.
Fees and scheduling
Published mediator rates are starting terms. A mediation is not scheduled or accepted until conflicts review is complete and the participants have received and accepted the written mediation terms. Cancellation, allocation of fees, minimum time, preparation, and payment requirements are stated in that agreement.
